1. Children under the age of 13

Our Website, the Hailo App and our Services are not intended for children under 13 years of age. Drivers, Your Information means:

  • ratings information (where other Hailo users (e.g., Hailo passengers) are able to rate you as a Hailo driver);
  • where you choose to use Hailo’s social networking features, such information that you post or is about you;
  • where you choose to reveal information regarding Hailo on on-line forums, blogs, message boards, chat rooms or similar locations;
  • location data;
  • driver performance, operational and financial details;
  • your responses to surveys that we might ask you to complete for research purposes;
  • your device type, your wireless phone carrier and your individual device ID;
  • information when you participate in a contest or promotion sponsored by Hailo;
  • information in the rare chance you report a problem with Hailo.

Passengers, Your Information means:

  • registration information provided by you to use Hailo such as your name, contact details such as address, e-mail address, and/or telephone number, other registration information or profile information, including any photographs, reporting information about your use of Hailo and payment details;
  • ratings information (where other Hailo users (e.g., Hailo drivers) are able to rate you as a Hailo passenger);
  • where you choose to use Hailo’s social networking features, such information that you post or is about you;
  • where you choose to reveal information regarding Hailo on on-line forums, blogs, message boards, chat rooms or similar locations;
  • location data;
  • your responses to surveys that we might ask you to complete for research purposes;
  • your device type, your wireless phone carrier and your individual device ID;

  • to provide you with marketing communications;
  • to monitor the use of Hailo;

  • to provide you with notices about your account/subscription, including expiration and renewal notices;
  • to help verify your identity;
  • to authorize your credit card;
  • to address or prevent fraud or prohibited or illegal activities;

  • to improve the Services and the content and layout of our Website and the Hailo App;
  • where you are a driver, to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
  • where you are a driver, to provide you and other drivers with relevant reports including aggregated information based on other drivers’ operation and financial performances (please note that this information will always be aggregated, anonymous, statistical information);
  • for any other purpose, with your consent.

3. Disclosure of Your Information

We may share or disclose non-private, non-personal, or aggregated information about our users without restriction.

We may disclose personal information that we collect or you provide as described in this Privacy Policy: to a parent company, our subsidiaries and affiliates;

  • to contractors, service providers, any suppliers, subcontractors (including payment providers) and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them;

  • to fulfill the purpose for which you provide it. For example, if we develop a “e-mail a friend” feature and you provide us with e-mails to use that feature, we will transmit the contents of that e-mail and your e-mail address to the recipients;

  • if we are under a duty to disclose or share Your Information in order to comply with any legal obligation or in order to enforce or apply the Driver or User Terms, and all other agreements, including for billing and collection purposes;

  • if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Hailo, our customers or others, or to prevent or stop activity we may consider to be, or to pose a risk of being, an illegal, unethical or legally actionable activity. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk protection.

You should take care when using any Hailo social networking features since the information you choose to make available can be seen by other users in the selected group. We do not monitor the use of such features in the normal course of business although we reserve the right to do so at our discretion.

You assume all responsibility for any loss of privacy or other harm resulting from your voluntary disclosure of Your Information.

3.1 How do we protect Your Information?

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. All information you provide to us is stored on our secured servers. Any payment transactions will be encrypted. The safety and security of Your Information depends on you. Where we have given you (or where you have chosen) a password that enables you to access certain parts of the Services, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we will do our best to protect Your Information, we cannot guarantee the security of this data. Any and all transmissions are at your own risk. Once we have received Your Information, we will use strict procedures and security features to try to prevent unauthorized access.

Additionally, we cannot control the actions of other users with whom you may choose to share Your Information. Therefore, we cannot and do not guarantee that Your Information will not be viewed by unauthorized persons.

We are not responsible for the circumvention of our privacy settings or security measures.

You may contact us to request access to, correct or delete any personal information that you have provided to us. In most, if not all cases, we cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If Your Information is amended or deleted, pre-amended or pre-deleted copies of Your Information may remain viewable in cached and archived pages, or might have been copied or stored by other Website users. We are not responsible for Your Information remaining viewable under these circumstances.

Once we disclose some of Your Information to third parties, we cannot access that information any longer and cannot force the deletion or modification of any such information by the parties to whom we have made those disclosures.
